Terms of Service & End User License Agreement (EULA)

1. Who we are

CallerPeek is developed and sold by:

("we", "us", "CONSALTEX"). These Terms govern the purchase and use of the CallerPeek software described in Section 2. By purchasing or installing the Software you accept these Terms.

2. The Software

"Software" means, depending on the edition purchased:

in each case together with access to the CallerPeek application for Android, distributed free of charge through Google Play, and the accompanying documentation.

The Software runs entirely on your own infrastructure. It does not connect to our servers, does not create user accounts with us, and does not transmit your data or your customers' data to us. See our Privacy Policy for details.

3. Ordering and payment

All orders placed on callerpeek.com are processed by our authorized reseller and merchant of record, Paddle. Paddle handles the checkout, payment processing, applicable taxes (VAT, GST, sales tax), invoicing, and customer billing support. Paddle's own terms (Paddle Checkout Buyer Terms) apply to the payment transaction. For refunds, see our Refund Policy.

Orders placed earlier at consaltex.pl, before we moved sales to Paddle, remain governed by the terms and conditions (Regulamin) published on that site, while these Terms apply to the license and use of the Software.

Prices shown at checkout include or exclude tax as indicated for your country. Delivery is electronic: after successful payment you receive an e-mail with a download link for the ZIP package and your license key. The Android application is installed from Google Play, free of charge.

4. License

4.1 PrestaShop module and Android application (proprietary license)

Subject to payment of the license fee, CONSALTEX grants you a non-exclusive, non-transferable, perpetual license to:

Each additional production shop requires a separate license.

You may not: (a) resell, rent, lease, sublicense, or redistribute the module or the application; (b) share your license key or device tokens with third parties outside your business; (c) remove copyright or license notices; (d) use the Software to provide a competing hosted service to third parties.

You may modify the module's source code for your own use within the licensed shop. Modified versions are used at your own risk and may not be eligible for support.

4.2 WooCommerce plugin (GPL notice)

The PHP code of the CallerPeek plugin for WooCommerce is licensed under the GNU General Public License v2 or later (GPL-2.0-or-later), as it builds on WordPress APIs. What you purchase is not the code itself but: the compiled distribution package, the included Android application (licensed under Section 4.1), your license key, and access to updates and support under Section 5. The "one production shop" scope in Section 4.1 defines the scope of update and support services for the plugin edition.

4.3 License key

Your license key identifies your purchase and grants access to Software updates and support. It does not restrict the operation of the Software: the Software continues to function without an active key or after the update period expires.

5. Updates and support

The purchase price includes 12 months of:

After 12 months the Software continues to work indefinitely. Continued access to updates and support may be renewed for an annual fee published on callerpeek.com. Renewal is optional.

6. Your responsibilities

You are responsible for: (a) meeting the technical requirements published on callerpeek.com (supported PrestaShop/WordPress/WooCommerce and PHP versions, valid SSL/HTTPS certificate, Android version); (b) creating backups of your shop before installing or updating the Software; (c) lawful processing of your customers' personal data displayed by the Software — you act as the data controller for that data (see Section 8); (d) securing device tokens and revoking tokens of lost devices or former staff.

7. Warranty and liability

The Software is provided with reasonable care and skill. To the maximum extent permitted by applicable law:

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer protection rights in your country of residence and liability for intentional misconduct. If you purchase as a consumer, statutory warranty rights for digital content under EU Directive 2019/770 and your national law remain unaffected.

8. Privacy and data protection

The Software connects directly from the Android application to the module installed on your server. CONSALTEX does not receive, store, or process your customers' personal data. With respect to the personal data displayed by the Software, you are the controller within the meaning of the GDPR; no data processing agreement with CONSALTEX is required because we do not process that data. 9. Termination

We may terminate your license if you materially breach Section 4 and fail to remedy the breach within 14 days of notice. Upon termination you must uninstall the module/plugin from production use. Sections 7 and 10 survive termination.

10. Governing law and disputes

These Terms are governed by the laws of Poland. If you are a consumer, this choice of law does not deprive you of protections granted by mandatory provisions of the law of your country of habitual residence. EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

11. Changes to these Terms

We may update these Terms for new versions of the Software or for legal reasons. The version in force at the time of your purchase applies to that purchase. The current version is always available at callerpeek.com.
